This is a day all those involved have long awaited but the question is, will it impact the current expansion plans that mirror that original development plan?
It’s a legal dilema whichever way the court rules.
If the judge sides with those opposed to the project and rules that the expansion should continue to be rejected, the mine will simply push ahead with its revised expansion plans.
Does this then mean all involve again face the same development approval process, planning assessment hearing, determination and possible appeal all over again?
Should the judge decide that the original mine plan was unflawed and should go ahead, what happens to the revised plan?
With jobs at risk and others simply trying to protect their properties, lifestyle and amenity, Monday’s decision won’t please everyone but at least it will be made public.
